歡迎閣下參與由信報財經新聞有限公司(“信報”)轄下的「信報網站www.hkej.com」提供的論壇 (“信報論壇”)。以下是信報論壇服務條款("服務條款")，信報按照條款的規定，為閣下提供這項服務。信報會不時修訂條款而無需特意通知閣下。修訂的服務條款將於公開張貼在www.hkej.com當日起即時生效，並取代舊有的條款。當閣下使用特定的信報論壇服務時，閣下均需要遵守該修訂及公開張貼(並不時重新張貼)的指引及規則。這些指引和規則均構成使用信報論壇服務條款的一部分。

ACCEPTANCE OF TERMS

Welcome to the www.hkej.com Forum ("HKEJ Forum") provided by Hong Kong Economic Journal Company Limited ("HKEJ").  The following are the terms and conditions with regard to the use of HKEJ Forum.  HKEJ provides the services of HKEJ Forum in accordance with the terms and conditions herein ("the Terms and Conditions").  HKEJ may in its own discretion and at any time without notice to you modify or revise the Terms and Conditions.  Such modifications or revisions shall be effective immediately upon by HKEJ’s posting the same on www.hkej.com and shall replace the relevant terms and conditions which were subject to modifications or revisions.  Any use of HKEJ Forum by you constitutes your agreement to be bound by any modifications or revisions and any guidelines or regulations which may be posted from time to time.  Those guidelines and regulations shall form part of the Terms and Conditions for your use of HKEJ Forum

信報為用戶提供線上論壇服務及其他相關的線上服務（"本服務"）。
閣下明白及同意本服務可能包括廣告，而這些廣告是信報為提供本服務所必須的。閣下亦明白及同意本服務可能包括經信報論壇發出的一些通訊，例如服務公告及行政信息，而這些通訊是本服務的一部份。
除非另有其他明文規定，增加或強化或改變目前本服務的任何新功能 (包括所推出的新產品)均受到本服務條款之規範。閣下了解也同意，本服務是依「現況」提供，信報均不予負責任何用戶通訊或個人化設定之時效、刪除、傳遞錯誤、和未予儲存的責任。信報可無須事先通知閣下保留暫停全部或部分之本服務以進行維修、保養、更新或其他信報認為適當的工作之權利。閣下必須自行取得本服務，及負責與此有關的第三方費用(例如互聯網供應商或按時收費)，包括與廣告展示或傳送有關之費用。此外，閣下必須提供取得本服務所需之一切必要裝備及支付有關費用。

DESCRIPTION OF USE OF HKEJ FORUM

HKEJ is providing user with discussion forum and other related services ("the Services") via the Internet and other electronic devices. 

You understand and agree that the Services may include advertisements and the advertisements are necessary to the provision of the Services by HKEJ.  You also understand and agree the Services might include some communications like service postings and administrative messages issued through HKEJ Forum and those communications shall form part of the Services.

Unless otherwise provided, addition enhancement or change by way of any new functions (including any new products) of and to the Services shall be subject to the Terms and Conditions.  You understand and agree that the Services are provided to you on "as is" basis.  HKEJ disclaims any liability as a result of any non-performance, deletion, transmission error or failure of storage of any communication or personalized settings.  HKEJ reserves the right to without giving any prior notice to you deactivate any or all of the Services in order to carry out repairs, system maintenance upgrading or any works that HKEJ thinks appropriate.  You shall be solely responsible for obtaining the Services and all the related expenses charged by the third parties (like Internet service provider or charges on consumption basis) including charges for transmitting any advertisement displays.  You shall be responsible for obtaining all the equipment and instruments for access to and use of the Services and all charges and expenses related thereto.

閣下的註冊義務

為了能使用本服務，閣下同意依本服務註冊表之提示提供閣下正確、精確、最新及完整的資料（"登記資料"），並確保登記資料完整及最新。若閣下提供任何錯誤、失實、過時、不完整或有誤導成分的登記資料，或者信報有理由懷疑登記資料錯誤、失實、過時、不完整或有誤導成分，信報有權暫停或終止閣下的帳號，並拒絕閣下於現在和未來使用本服務之全部或任何部份。信報亦十分關切所有使用者（特別是兒童）的安全及私隱。

REGISTRATION OBLIGATION OF USER

In consideration of HKEJ's provision of the Services, you agree to provide accurate correct updated and complete personal information of yours as required by HKEJ (“registration information”) and to maintain the same complete and updated.  If you provide inaccurate wrong outdated incomplete or misleading registration information or if HKEJ has reason to suspect the same to be inaccurate wrong outdated incomplete or misleading, HKEJ has the right to suspend or discontinue or terminate your account and disallow your existing and future access to the Services in whole or any part thereof.  HKEJ is very concerned with the safety and privacy of all the users in particular the children.

PRIVACY POLICY

用戶帳號、密碼及安全

閣下將收到一個密碼及帳號以供閣下個人使用。閣下必須維持密碼及帳號的機密安全。閣下需要對該帳號的一切行為負責。閣下同意當閣下的密碼或帳號遭到未獲授權的使用，或者其他任何安全問題發生時，閣下將立即通知信報及每次連線完畢，閣下將結束閣下的帳號使用。信報不會負責因閣下未能遵守本項規定所衍生之任何損失或損害。如帳號被人盜用，閣下必須立即通知信報。

USER LOGIN I.D. PASSWORD AND SECURITY

You will receive password and login id for your personal use.  You should be responsible for maintaining the confidentiality of your password and login id.  You should also be responsible for any and all activities and conducts that occur under your account.  You agree to notify HKEJ of any unauthorized use of your password or login id or any other breach of security.  You also agree to terminate and log out your account whenever you finish using the Services.  HKEJ disclaims any liability for any loss and damage as a result of your failure to comply with this Clause.  You agree to notify HKEJ immediately of any unauthorized use of your account

閣下了解及確認一切的資訊、資料、文字、軟件、音樂、音訊、照片、圖形、視訊、信息或其他資料（"內容"），無論其為公開張貼或私下傳送，均為內容提供者之個人責任，與信報無關。閣下，而非信報，將對經由本服務上載、張貼、發送電子郵件或傳送之內容負上完全的責任。信報無法控制經由本服務而張貼之內容，因此不保証內容之正確性、完整性或品質。閣下了解使用本服務時，可能會接觸到令人不快、不適當、令人厭惡之內容。在任何情況下，信報均不為任何內容負責，包括但不限於任何內容之任何錯誤或遺漏，以及經由本服務張貼、發送電子郵件或傳送而衍生之任何損失或損害。

閣下同意及承諾不將本服務作以下用途：

1. 上載、張貼、發送電子郵件或傳送任何非法、有害、脅迫、濫用、騷擾、侵害、中傷、粗俗、猥褻、不道德、誹謗、侵害他人私隱、有害或種族及性別歧視的或含有非法成份之內容;
2. 以任何方式傷害任何人／任何機構;
3. 冒充任何人或機構，包括但不限於信報主管、論壇領袖、主持人，或以虛偽不實的方式陳述或謊稱與任何人或機構之關係;
4. 偽造標題或以其他方式操控識別資料，以偽裝經由本服務傳送之任何內容之來源;
5. 將依據任何法律或契約或信任關係（例如由於僱傭關係和依據保密合約所得知或披露之內部資料、專屬及機密資料）而無權傳送之任何內容加以上載、張貼或以其他方式傳送;
6. 將侵害任何人之任何專利、商標、商業秘密、版權或其他專屬權利之內容加以上載、張貼或以其他方式傳送;
7. 將任何廣告信函、促銷資料、垃圾郵件、濫發信件、連鎖信件、直銷或其他任何形式的勸誘資料加以上載、張貼或以其他方式傳送;
8. 將設計目的在於干擾、破壞或限制任何電腦軟件、硬件或通訊設備的電腦病毒，包括但不限於「木馬屠城」病毒（Trojan Horses）、蠕蟲（worms）、「計時炸彈」(time bombs) 或刪除蠅（cancelbots），或其他電腦代碼、檔案和程式之任何資料，加以上載、張貼、發送電子郵件或以其他方式傳送;
9. 破壞正常的對話流程、造成螢幕快速移動，或使本服務其他使用者無法輸入或傳送訊息，或對其他使用者參加即時交流的能力產生負面影響;
10. 干擾或破壞本服務或與本服務相連線之伺服器和網路，或不遵守於本服務連線網路之規定、程序、政策或規範;
11. 故意或非故意違反任何適用的本地、國家或國際法律及規則，以及任何具有法律效力之規定;
12. 「跟蹤」或以其他方式騷擾他人;及
13. 蒐集或儲存其他使用者之個人資料。

閣下了解及確認信報並未針對內容事先加以審查，但信報及其指定人仕有權（但無義務）依其自行之考量，拒絕和移除可經由本服務提供之任何內容。在不限制前述規定之前提下，信報及其指定人仕有權將違反本服務條款和令人厭惡之任何內容加以移除。閣下使用任何內容時，包括依賴內容之正確性、完整性或實用性之情形，閣下同意必須自行加以評估並承擔所有風險。因此，閣下確認閣下不得依賴信報創造或接受之任何內容，包括但不限於本服務其他之部分。

信報論壇是以即時上載留言的方式運作。信報對所有留言的真實性、完整性及立場等，不負任何法律責任。而一切留言之言論只代表留言者個人意見，並非信報之立場。由於信報論壇受到「即時上載留言」運作方式所規限，故不能完全監察所有留言，若讀者發現有留言出現問題，請立即以電郵方式聯絡我們。

閣下了解並同意，信報依據法律或規定的要求，或基於誠信為了遵守法律程序、執行本服務條款、回應任何內容侵害第三者權利之主張，或保護信報、其使用者及公眾之權利、財產或個人安全的情況下，認定必須將內容加以保存或揭露時，得加以保存及揭露。

閣下了解本服務之技術處理及傳送，包含閣下之內容，可能經由各個網路加以傳送，且為了符合及配合連線網路或裝置之技術要求而進行改變。

USER'S CONDUCT

You understand and confirm that the third party content provider shall be solely responsible for his information data text software music sound photographs graphics video news or other contents ("the Contents") so submitted whether posted publicly or transmitted privately and HKEJ takes no responsibility therefor.  You but not HKEJ shall be solely responsible for all of the Contents so uploaded posted delivered by email or transmitted through the Services.  HKEJ cannot control the Contents so posted through the Services and does not guarantee the accuracy, integrity and quality of the Contents.  You understand when using the Services you may be exposed to any of the Contents which may be unpleasant improper or disgusting.  In no circumstances shall HKEJ have any responsibility on the Contents including but not limited to any mistake or omission of the Contents or any loss or damage whatsoever as a result of posting email delivery or transmission of the Contents through the Services.

You agree and undertake not to use the Services for any of the following purposes:-

1. to upload display send email or transmit any of the Contents which may be illegal damaging threatening abusing harassing infringing defamatory obscene indecent immoral privacy infringing race and sex discriminating or unlawful;
2. to cause damage to any person or entity by whatsoever means;
3. to falsely claim to be any person or entity including but not limited to the publisher or the administrator of HKEJ, the leader or host of HKEJ Forum, or misrepresent as to your relationship with any person or entity by fraudulent dishonest or improper means;
4. to falsely make a headline or take control of identifiable information by whatever means in order to mislead the origin of any of the Contents transmitted through the Services;
5. to upload display or transmit by whatever means any of the Contents which is unauthorized in accordance with any law or trust or confidentiality (like internal information or patented or confidential information disclosed or obtained as a result of employment relationship and confidential contract);
6. to upload display or transmit by whatever means any of the Contents that may infringe any patent trademark business privacy copyright or other intellectual property rights of any persons;
7. to upload display or transmit by whatever means any advertising promotion sales information junk mails spamming chain letters direct sales or other inducing materials;
8. to upload display send email or transmit by whatever means of any of the Contents which contain viruses including but not limited to Trojan Horses, worms, time bombs, cancelbots or other computer codes, files or programs in order to calculate to interfere with disrupt or restrict any computer software hardware or communication appliances;
9. to disrupt normal flow of dialogues,  to cause the screen flashing, or to cause other users unable to type or transmit messages or to defer or cause any negative effect to the capability of instant communication amongst other users;
10. to interfere with or disrupt the Services or the server and network connected for the Services or  irregulate the same with its specifications, procedures policy or regulations;
11. to be in breach of any applicable local national or international law and regulations and other rules with legal force whether intentionally or unintentionally;
12. to track or interfere other persons by whatever means; and
13. to collect or store personal information of other users.

You understand and acknowledge that HKEJ does not and will not examine and monitor any of the Contents.  However, HKEJ and other authorized persons reserve the right but are not under any obligation to refuse and remove any of the Contents provided by the Services in their own discretion.  Without prejudice to the aforesaid, HKEJ and other authorized persons reserve the right to remove any of the Contents which may be in breach of the Terms and Conditions and disgusting.  You agree to be solely responsible for assessing and shall bear the risks in using any of the Contents including relying on the accuracy, integrity or practicability of any of the Contents.  You therefore warrant that you shall not rely on any of the Contents created or accepted by HKEJ including but not limited to any other parts of the Services.

HKEJ Forum is operated by instant upload system.  HKEJ disclaims any liability in terms of the accuracy, integrity and legality of any of the Contents.  All comments opinions and expressions posted on HKEJ Forum represent the individual comments opinions and expressions of the particular users but not HKEJ's.  As HKEJ Forum is subject to the restriction of instant upload system specification, HKEJ cannot examine and monitor all the comments opinions and expressions so posted on HKEJ Forum.  You should inform us by email to report any problems concerning the same.

You understand and agree that HKEJ may as it deems fit and appropriate store or disclose any of the Contents in order to comply with any legal or prescribed requirements or to comply with any legal proceedings, to execute and give effect to the Terms and Conditions, to reply to any allegations and claims made by any infringed third parties or to protect the interests property and security of HKEJ, other users and the general public.

You understand the Services including the Contents submitted by you may be modified or changed as a result of different specifications of individual network or settings in the transmission process.

國際使用之特別警告

閣下了解網際網路並無國界限制，亦同意遵守當地所有相關規定之網上行為及可接受內容之法規。閣下特別同意遵守關於從香港或閣下居住的國家或地區輸出技術性或個人資料所有相關法律。

WARNINGS TO INTERNATIONAL USAGE

You understand there is no boundary restriction in network.  You also agree to comply with all applicable regulations governing the Internet activities and applicability of the Contents.  You in particular agree to comply with the relevant laws regarding personal data or data transmission in Hong Kong or country or area of your residence or the country from and to which the information was transferred.
